  • NIW EB2 WOM, MA District Court, I485 pending over 2.5 years due to name check, filed WOM 3/2007, AUSA filed MTD, then responsed to MTD. Went to hearing in the Middle of Nov 2007, got I485 approved on Nov 30, 2007 (last day before the visa retrogression for EB2). Related details for this case 1  2

  • EB2 WOM, New Mexico Court, name check got clear BEFORE AUSA filed MTD, AUSA try to convince plaintiff to dismiss the case because no visa available for EB2. Plaintiffs disagreed and AUSA filed MTD. Plaintiffs filed response, meanwhile filed EB1a and EB1b I140. Luckly both got EB1 approved soon and relinked I485, got I485 approved BEFORE Judge take action.

  • EB1 WOM at WI Western district court, I485 pending over 4 years due to name check, file WOM end of Jan 2008, I485 approved end of Feb 2008

  • EB1 WOM at NJ District court, filed WOM Nov 1, 2007. AUSA filed MTD, then response to MTD on early January, at the end of Feb 2008, instead of dismissed notice (not nice Court for Name check WOM), got I485 approval notice.

  • EB2 WOM, NY Eastern District Court, case filed end of Nov 2007, AUSA filed MTD, then response with objection to MTD at early Feb 2008, I485 (husband, wife and son) were approved on March 3, 2007 (first day when PD become current )

  • Naturalization case without interview, pending over 3 years due to name check, this is the famous PA Eastern naturalization case (Judge put 6 cases together,name check memo was disclosed in the AUSA's response. see related report 1 2 3 4 5 Applicant was interviewed on March 12, 2008, and become U.S. Citizen afternoo.

  • EB3 WOM, MA district Court, filed WOM at end of Nov, ask for twice for extension to wait for visa number, got approved 3/3/2008 (first day of PD current)

  • EB1 WOM, name check pending over 3.5 years. CT district Court, filed WOM at end of Jan 2008, USAS asked for 1 month extension before due day, then approved whole family greencard right before the deadline for answering the complaint. This is a very interested case. see details here

  • Naturalization with interview done, this is the fastest case we even completed. It happended in Idaho District Court, Submit complaint to the Court early April 2008, two weeks after submit WOM, he finished the second FP and got naturalization ceremony notice (did FP 4/16/2008, 4/17/2008 afternoon he got call from AUSA and told him that the naturalization ceremony notice is on the way, will ask the Judge to remand the case to USCIS so they can complete the application). The WOMer currently work in China and came back US for 3-week vacation, and solved the lawsuit during the vacation period. See details in Chinese here

  • Filed WOM at CA Central District Court. Marriage-based Green card application filed on January 2004, done everything to push and failed. Filed WOM at the end of Oct 2007. Then government filed motion to dismiss. At that time, plaintiff went on vacation, and when he came back on Friday and found that he have to response by next Monday, and came to us for preparing his response. Working over-time on that weekend, we drafted the response for him. In Feb 2008, USCIS approvied his case before the Judge take the case.

  • Northern of CA district Court, Naturalization with interview done, filed WOM at the end of Feb 2008, in April, got ceremony notice for naturalization.

  • District of Illinois, naturalization with interview done. Filed N400 on Sept 2005, and was interviewed in 2006, has pending since then due to name check. So sick of endless waiting, talk with us for possible solution. Our answer: "file WOM today and you will get it solved with 1-2 monthes". So filed WOM in the middle of March 2008, two weeks later, got FP notice. Talked with AUSA, his word is "feel sorry for her, ask her to enjoy the scheduled vacation, he will take care of everything --- sound like her attorney, not for governmenet ! Soon got notice for second interview and passed it, and was schedule for naturalization in May, see here

  • District of MD (very anti-immigrant WOM Court, the district Court Judges dismissed many cases for the reason of lack jurisdiction), EB1 approved in 2004, I485 pending since 2004 due to name check. Think of filing WOM BEFORE the Feb 2008 Name Check Memo, then hold the WOM and hope the name check memo will solve his case. After more than 2 months hopeless waiting, filed WOM at the end of April 2008. Got email from USCIS middle of May and was told them their I-485s were approved. see here

  • Eastern District of Michican for naturalization application without interview. This is very anti-immigrant WOM Court, the court Judges dismissed many cases for the reason of lack jurisdiction, but March 2008, the first favorable case came from this Court, and encourage this WOMer to submit the complaint, and only after two week he submitted the WOM, he received notice for arrangement of interview. Even not naturalized yet, but he became very closed to the final goal. See detail here, update: he passed the interview got ceremony notice for naturalization in the middle of August 2008.

  • NJ District Court. Filed Naturalization Dec 2006. Because his wife's F1 will be expire soon and need his citizenship to sponsor her green card. So he insist to file WOM even We NOT recommend for his case due to short-time (1 year 4 month) waiting. Filed WOM at the end of April 2008, got Motion to Dismiss end of July, we prepared the response to the MTD. Middle August 2008, he received the notice for the interview. see details, including his email communication with us here

  • Another NJ District Court case. File I-485 on Sept 2005 (EB-2), got MTD on June 23, we prepred the response for him and submitted on July 10, 2007. Got I-485 on Aug 2,2008, second day since his PD become current. See here

  • Got Naturalization interview notice soon after filing WOM. Not surprised since it is from Northern District of California, the most friendly Court for immigrant WOM.

  • Northern District of Georgia Court, Filed WOM for pending I-485 (NIW PD: June 2005, I485 RD June 2005)(she plan to file WOM Oct 2007, but acted too slow that visa retrogressed Nov 2007. Once her PD became current on August 2008, she filed WOM without hesitation. Got GC middle of Sept 2008 (just avoid another visa retrogression)

  • MA Court, USCIS totally messed up her case, see here. File WOM Middle August 2008, got I-485 approved Email on Sept 19, 2008. File I485 in 2004, Marriage-based I-485.
